I,____________(“Participant”) hereby acknowledge that I, with informed consent of my parent/guardian identified below (if applicable), have voluntarily elected to participate in High Road Scholars Camp (hereinafter the "Program") being organized by High Road Scholars LLC  (hereafter, the “Organizer”). 

In consideration of being permitted to participate in the Program by the Organizer, I hereby acknowledge and  agree to the following: 

I have been informed of and I understand the various aspects of the Program. I have elected to participate in the travel, itinerary, logistics, and related Program activities. I also understand that as a Participant in the Program, I may sustain serious personal injuries, illness, property loss or damage, or even  death as a consequence of the actions, inactions or negligence of myself or others, travel, weather conditions, and other risks not known to me or not reasonably foreseeable at this time. I further understand and agree that any such injuries and consequences that I may sustain by any means are my sole responsibility.  Furthermore,  I will provide evidence of medical and health insurance.

I understand there are potential risks inherent to my participation in the Program and these potential risks include but are not limited to: (a) travel to and from the Program; (b) local travel within the Program site; (c) consumption of food; (d) weather conditions; (e) negligent first aid operations or procedures; (f) animal encounters; (g) poisonous plants; (h) falls, sprains, and fractures; (i) drowning; (j) illness; (k) allergic reactions; (l) exacerbation of pre-existing medical conditions; (m) infections; (n) homesickness; (o) anxiety; (p) difficulty fitting in and peer pressure; (q) doxing; (r) inadequate available medical services; (s) delays in medical attention; (t) difficulties in communication with parents/guardian in an emergency; (u) malfunctioning equipment; (v) theft; (w) sharing sleeping quarters with other participants without 24-hour adult supervision; and (v) other risks. Although the Organizer has made reasonable effort to assure my safety while participating in the Program, I understand that there are unavoidable risks. I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Releasees (defined below) and I voluntarily  assume full responsibility for my participation in the Program.  

I understand and agree that, although the Organizer will attempt to maintain the Program as described in its publication materials, it reserves the right to change the Program including, but not limited to, the curriculum, hosts, itinerary, travel arrangements, or accommodations at any time and for any reason, with or without notice, and that the Organizer, or its employees and agents, shall not be responsible or liable for any expenses or losses that I sustain as a result.  

I have no known physical or health-related reasons or problems that may preclude or restrict my participation in  the Program and related activities, or I have disclosed to the Organizer any physical, mental, and/or emotional conditions or problems, permanent or temporary, including special dietary and medication needs, or the need  for visual or auditory aids that might impair my ability to participate in the Program. I will not hold the Organizer liable for any adverse reactions as a result of not providing accurate information regarding my conditions.  

I understand and agree that I must comply with all applicable Organizer rules, regulations and policies  governing students. I understand and agree that the Organizer reserves the right to dismiss me from the  Program at any time should my actions or general behavior, in the sole discretion of the Organizer, be  determined to constitute a danger to myself, others, or is a detriment to the progress and objectives of the  Program in any way. 

I further agree that receiving any inoculations (if necessary) is my responsibility and I will not hold the Organizer liable for any adverse reactions as a result of taking the inoculations or illness abroad or at home  due to not taking the inoculations. I will make all preparations necessary to safeguard my health and comply  with all recommended precautions pertaining to my health and safety. I have further arranged, through  insurance or otherwise, to meet any and all needs for payment of health care coverage or medical costs that I may incur while I participate in the Program.  

I, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter  collectively, "Releasor," "I" or "me", which terms shall also include Releasor's parents or guardian if Releasor  is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, and hereby waive and  release the Organizer and each of their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively, the "Releasees"), from any  physical or psychological injury  that I may suffer arising out of or related to my participation in the Program.  

I FURTHER AGREE that the Organizer is not in any way responsible for my well being with respect to any travel destinations and/or participation in activities beyond those specifically sponsored and led by the Organizer, including those activities that I may choose to undertake  before, during, or after the Program.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs arising from injuries I sustain while participating in the Program, or while participating in activities outside of the Program-sponsored events.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Organizers to provide all emergency medical care deemed  necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree  to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. 

I FURTHER ACKNOWLEDGE that this Program may involve a test of a person's physical and mental limits  and may carry with it the potential for death, serious injury, and property loss. I agree not to participate in the Program unless I am medically able and properly trained, and I agree to abide by the decision of the Organizer, regarding my approval to participate in the Program. 

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED PROGRAM AND I AM PARTICIPATING  IN THE PROGRAM ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH  PARTICIPATING IN THIS PROGRAM, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR  PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR  PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I  UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS'  NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE PROGRAM DESTINATION, OR  FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS,  BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY. 

I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY  UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND  DISCHARGE ORGANIZER ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS,  STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS,  FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR  WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST THE RELEASEES FOR PERSONAL INJURY OR PROPERTY DAMAGE. 

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Releasees.

I agree that this Release shall be governed for all purposes by California law, without regard to any conflict of  law principles, and that any dispute related to this WAIVER AND RELEASE OF  LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT or to the Program shall be heard exclusively in the Superior Court of Alameda County, California, even if I do not reside in that county. This  Release supersedes any and all previous oral or written promises or other agreements. 

In the event that any damage to equipment or facilities occurs as a result of my or my family's or my agent's  willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs  associated with any such actions of neglect or recklessness. 

THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN  THE PROGRAM, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION. 

THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be  interpreted as an agreement between two parties of equal bargaining strength. The undersigned agrees that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted  altering or explain the terms of this agreement, but that it will be interpreted based on the language in  accordance with the purposes for which it is entered into. 

In the event that any provision contained within this WAIVER AND RELEASE OF  LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT shall be deemed to be severable or  invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or  otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court  should find any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it  would become valid and enforceable, then said provision shall be deemed to be written, construed, and enforced as so limited.
